Terms of Reference for Consultancy Service for Claims Specialist
Background
Project management office of Tajikistan is managing several contracts for execution of CASA-1000 project. Several of these are Design, engineer, supply, Install and maintenance support post completion. The construction has reached an advanced stage and would now require the services of an experienced contract management/ claim specialist with specific experience in contract negotiation and dispute resolutions to provide services to the PMU in handling the claims raised by the Sangtuda Converter Station contractor (Contract called TW01) or by the PMU on the same contractor for not completing contract requirements.
Objectives
The main objectives of the required consultancy services are as follows.
1. Review and analyze the Contractor’s claims and notices and provide expert opinion.
2. Review the response to Employer’s notice of deficiencies, identify the one to be pursued further.
3. Preparation, defense, and /or negotiation of claims for extension of time, loss and/or expense, or
general claims.
4. Assist/advise the Employer in the assessment of Contractor’s claims.
5. Assist in preparation of plan for negotiations with the Contractor to arrive as a first priority amicable settlement. If amicable settlement can’t be arrived in a reasonable time, support PMU in exploring other remedies available in the contract.
